Biography

Don Emil Brand focuses his practice on representing individuals and businesses in a variety of civil, business, and real estate matters. He has particular expertise in the area of Internet defamation. He has assisted individuals and businesses in removing untruthful and damaging content from the Internet, such as negative online reviews, defamatory social media posts, privacy violations, and revenge websites. Such user-generated content is often posted on the Internet anonymously, and Mr. Brand utilizes a variety of legal techniques to uncover the true identities of the offenders and obtain court ordered relief for victims. Mr. Brand also believes that users who publish truthful and accurate information on the Internet should not be retaliated against for exercising their right to free speech and has defended individuals and businesses who have been unfairly and wrongfully sued based on content they have posted online.

In addition to his passion for Internet defamation law, Mr. Brand has extensive experience in representing individuals and businesses in bankruptcy proceedings and related litigation matters. He has received extensive and advanced training in Max Gardner’s Bankruptcy Litigation Model and has served as special counsel to a Chapter 7 Trustee. Mr. Brand has been selected a bankruptcy Rising Star by Super Lawyers for 5 years in a row, from 2013 to 2017. He has provided hundreds of hours of pro bono counsel and advice to individuals in economic distress.

Mr. Brand also represents individuals and businesses in investigations and proceedings brought by the U.S. Department of Justice, the Office of the United States Trustee, the U.S. Department of Housing and Urban Development, the Attorney General of California, and other state and federal agencies.

His favorite charities to which he donates include the Environmental Defense Fund and Mazon: A Jewish Response to Hunger. In his free time, Mr. Brand enjoys hiking, reading, taking long walks with his dog, Noah, and searching for great “hole in the wall” restaurants throughout Orange County. Mr. Brand is also an Instrument Rated Private Pilot and has an Amateur Radio Technician License with the FCC with an assigned Call Sign of KM6OZI.
